Prenups, Name Changes, and More

Prenups / Postnups

There are many reasons why a prenup / postnup is a good idea. In fact it has become common place.

Oftentimes, a party will want to protect the financial interests of children from a previous marriage. “The premarital agreement can ensure that assets remain separate property and allow the party to create a living trust or will to provide for their children in the event of death,”

Whatever your reason having one in place can give both parties peace of mind.

It should be noted that a little less than 50% are disallowed by a court. It's a good idea to keep it updated as your particular situation changes over time.

Name Change

Changing your can be a done fairly quickly and easily in most cases.  Typically, you may legally change your name to whatever name you'd like, although state marriage laws may also provide some additional legal guidance. You may want to separate yourself from a particular person or a time or event in your life or to stop a former partner finding you or to anglicise a foreign name, that is — to change the form or spelling to make it more understandable for English speakers.

There are some exceptions though. For example, you can't: Change your name to escape debt liability or hide from criminal liability.

Quit Claim Deeds

Quit Claim Deeds are used primarily to add or remove a party from the title to the property. A quit claim deed must be signed and notarized and then recorded at the county recorders office.

When using a Quit Claim Deed it is possible that the parties will need to pay a transfer tax. This can quickly add up to thousands of dollars. Many times we are able to get an exempt status so as to not have to pay that tax.
